These Terms & Conditions (“Terms”) govern your use of https://www.dominickspizza.net (the “Site”), operated by Dominick’s Pizza (“we,” “us,” or “our”), and your participation in the Dominick’s Pizza Text Club. By using the Site or opting in to receive text messages from us, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.
1. Use of the Site
You may use the Site only for lawful purposes. You agree not to interfere with the operation of the Site, attempt to gain unauthorized access to any systems, or use the Site in any way that violates applicable law.
2. Menus, Pricing & Availability
Menu items, prices, specials, hours, and delivery areas shown on the Site are subject to change at any time without notice. Delivery is offered in limited areas — please call ahead at 630.832.6929 to confirm. In the event of a pricing or menu error on the Site, the information at the restaurant controls.
3. Online Ordering
Online orders are processed through a third-party online ordering provider. Your use of that service is governed by the provider’s own terms and privacy policy.
4. Text Messaging Program — Dominick’s Pizza Text Club
4.1 Program Description
The Dominick’s Pizza Text Club (the “Program”) is a recurring mobile messaging program that sends marketing and informational text messages — for example, promotions, specials, coupons, event announcements, and general updates — to customers who have opted in. Messages may be sent using an automatic telephone dialing system (autodialer).
4.2 Opt-In and Consent
You can join the Program by submitting the sign-up form on our Text Club page. By submitting that form and signing up for texts, you consent to receive text messages (e.g., promotions, specials, events, and general updates) from Dominick’s Pizza at the number provided, including messages sent by autodialer. Consent to receive marketing text messages is not a condition of any purchase. Msg & data rates may apply. Msg frequency varies.
4.3 Opting Out
You can cancel the Program at any time by replying STOP to any text message you receive from us. After you text STOP, you will receive a final message confirming that you have been unsubscribed, and you will no longer receive Program messages. You can also unsubscribe at any time by contacting us at 630.832.6929 or [email protected]. If you would like to rejoin, simply sign up again through the Text Club page.

4.5 Message Frequency, Fees & Carriers
Message frequency varies. Message and data rates may apply to each message sent or received, according to your mobile plan — contact your wireless carrier with questions about your plan. Wireless carriers are not liable for delayed or undelivered messages. The Program is offered on an “as is” basis and may not be available in all areas at all times or on all carriers.
4.6 Eligibility & Your Responsibilities
You must be at least 18 years old (or have the consent of a parent or legal guardian) to participate in the Program. By opting in, you represent that you are the account holder or customary user of the mobile phone number you provided. You agree to notify us promptly if you change or deactivate your mobile number, so that we do not send messages to a number that no longer belongs to you.
4.7 Privacy
Mobile information collected through the Program is used and protected as described in our Privacy Policy. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Dominick’s Pizza does not sell, rent, or share customer phone numbers or opt-in information with third parties.
5. Intellectual Property
All content on the Site — including text, images, logos, and graphics — is the property of Dominick’s Pizza or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from Site content without our prior written permission.
6. Disclaimer of Warranties
The Site and the Program are provided on an “as is” and “as available” basis, without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure.
7. Limitation of Liability
To the fullest extent permitted by law, Dominick’s Pizza will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or participation in the Program.
8. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the Effective Date above. Your continued use of the Site or continued participation in the Program after changes are posted means you accept the updated Terms.
9. Governing Law
These Terms are governed by the laws of the State of Illinois, without regard to its conflict-of-law principles. Any dispute arising out of these Terms or your use of the Site will be brought in the state or federal courts located in DuPage County, Illinois.
